Service Description: By subscribing to our snow removal services, you acknowledge that Ponderosa Pathways LLC will provide snow removal and related services as described in the chosen subscription package. This includes snow removal from designated areas, such as driveways and pathways, and additional services as specified in the chosen subscription.
2. Limitation of Liability: While we strive to provide efficient and reliable snow removal services, Ponderosa Pathways LLC is not responsible for any damage to property, vehicles, or any items located beneath the snow, including but not limited to buried objects, landscaping, or structural elements. It is the responsibility of the property owner to ensure the area is clear of obstacles before our services commence.
3. Snow Depth and Condition: Our services are contingent on weather conditions and the depth of snowfall. Ponderosa Pathways LLC reserves the right to modify the timing and frequency of snow removal visits based on these conditions. We aim to meet the service standards outlined in the selected subscription package but cannot guarantee uninterrupted service during extreme weather events.
4. Additional Charges: Any additional services requested by the subscriber, beyond the scope of the selected subscription package, may incur additional charges. These services may include but are not limited to de-icing, sidewalk clearing, or removal of heavy ice and compacted snow.
5. Subscriber Responsibilities: Subscribers are responsible for ensuring that the areas to be cleared are free of obstacles and hazards, including vehicles, objects, and personal belongings. Subscribers must also adhere to local regulations and keep their property safe and accessible during the winter season.
6. Damage Claims: Any damage claims resulting from our snow removal services must be reported to Ponderosa Pathways LLC within 24 hours of the service visit. We will assess the claim and take appropriate action, as deemed necessary.
7. Subscription Agreement: By subscribing to our snow removal services, you agree to the terms and conditions outlined in this agreement. It is the subscriber’s responsibility to review and understand these terms. Failure to comply with the terms may result in termination of the subscription.
8. Termination of Subscription: Ponderosa Pathways LLC reserves the right to terminate or suspend a subscription at its discretion, particularly in cases of non-payment, violation of terms, or failure to provide access to the property.
9. Agreement Changes: Ponderosa Pathways LLC may modify the terms of this agreement with prior notice to subscribers. Subscribers will have the option to accept the modified terms or cancel their subscription.
10. Governing Law: This agreement is governed by the laws of Ponderosa Pathways LLC, and any disputes arising from this agreement will be subject to the jurisdiction of the courts in Flagstaff, Arizona.
11. Liability Disclaimer and Safety Notice:
a. Slip and Fall Risks: You acknowledge and agree that snow and ice removal is an ongoing process, and while we will make reasonable efforts to keep your property clear, we cannot eliminate all slip and fall risks. It is your responsibility to exercise caution and ensure your safety while navigating snowy or icy areas on your property. Ponderosa Pathways LLC is not liable for any injuries, accidents, or damages resulting from slip and fall incidents on your property.
b. Ongoing Weather Events: Snowfall and winter weather conditions can be unpredictable and may require multiple service visits to maintain safe conditions. Ponderosa Pathways LLC will strive to meet the service standards outlined in your selected subscription package. However, you acknowledge that ongoing weather events may affect the timeliness and effectiveness of our snow removal efforts.
c. Property Accessibility: You are responsible for keeping your property accessible and safe for our snow removal team to perform their services. This includes removing obstacles, and ensuring that our team can access all designated areas. Failure to provide access may result in service delays and additional charges.
d. Indemnification: You agree to indemnify and hold Ponderosa Pathways LLC harmless from any claims, damages, liabilities, or expenses, including legal fees, arising from injuries, accidents, or property damage that occur on your premises, regardless of whether they are related to our snow removal services. You are responsible for notifying your guests, tenants, or occupants of the potential hazards associated with winter weather.
e. Limitation of Liability: In no event shall Ponderosa Pathways LLC be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to property damage, personal injury, or loss of use, arising out of or in connection with our snow removal services.
12. Agreement Acceptance: By subscribing to our snow removal services, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this agreement, including the liability disclaimer and safety notice.
